(1) These General Terms and Conditions (hereinafter "GTC") apply to the use of the web application Pendlify (hereinafter "Platform" or "we"). By registering and using Pendlify, you (hereinafter "User") accept these GTC as binding.
(2) Pendlify provides users with tools for managing finances, profiles, currencies, and market/price information (including PND token indicators).
(1) The use of certain features of Pendlify requires registration. The user is obliged to provide truthful information during registration and to keep it up to date at all times.
(2) Every user is solely responsible for the security of their access data (including passkeys, passwords, and 2FA). Activities carried out via a user account will be attributed to that account unless the user is not responsible for the misuse.
(1) Pendlify provides market information, currency conversions, and price histories. This data is for informational purposes only.
(2) No Financial Advice: The rates, values, or calculations presented on the platform do not constitute investment advice, financial recommendations, or a solicitation to buy or sell financial instruments or cryptocurrencies.
(3) No liability is assumed – to the extent permitted by law – for the accuracy, timeliness, and completeness of course and market data.
(1) The user agrees not to misuse Pendlify for illegal purposes.
(2) It is prohibited to bypass platform security measures, use automated scrapers/bots without permission, or distribute malware.
(3) In the event of violations of these GTC, the operators reserve the right to temporarily suspend or permanently delete the user account.
(1) Pendlify is unrestrictedly liable for intent and gross negligence as well as in accordance with the Product Liability Act.
(2) For slight negligence, Pendlify is only liable for the breach of essential contractual obligations (cardinal obligations), the fulfillment of which makes the proper execution of the contract possible in the first place and on whose compliance the user may regularly rely. In this case, liability is limited to foreseeable, typically occurring damage.
(3) Liability for data loss, technical failures, internet connection interruptions, or incorrect price displays by third-party interfaces is excluded to the extent permitted by law.
The processing of personal data takes place in accordance with our privacy policy, which is an integral part of these GTC.
Pendlify reserves the right to change these GTC at any time with effect for the future. Users will be informed of significant changes in a timely manner. If the user does not object to the validity of the new GTC within a period of 14 days after notification, the changed GTC are deemed to have been accepted.
(1) The law of the country in which Pendlify has its registered office shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) Should individual provisions of these GTC be or become ineffective, the effectiveness of the remaining provisions shall remain unaffected.
